Acceptance of Terms

By accessing or using PDFem (pdfem.com), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our service. These Terms constitute a legally binding agreement between you and PDFem.

Description of Service

PDFem provides free online file conversion tools that allow users to convert, merge, split, compress and manipulate PDF files and images. The service is provided through a web-based interface accessible at pdfem.com. No software installation or user registration is required to use the service.

The service operates by allowing you to upload files to our servers, where they are processed using our conversion engines and then made available for you to download in the requested format. All uploaded and converted files are automatically deleted from our servers within 10 minutes of processing.

Use of the Service

Eligibility

You must be at least 13 years of age (or 16 years of age in the EEA) to use PDFem. By using our service, you represent and warrant that you meet this age requirement.

Acceptable Use

You agree to use PDFem only for lawful purposes and in a manner consistent with these Terms. You may use the service for personal, educational and commercial file conversion purposes.

Prohibited Uses

You agree not to use PDFem to:

  • Upload, convert, or distribute any material that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable under any applicable law.
  • Upload files that contain malware, viruses, trojans, or any other malicious code.
  • Attempt to gain unauthorized access to our servers, systems, or networks.
  • Interfere with or disrupt the service or the servers and networks connected to the service.
  • Use automated tools, bots, or scripts to access the service in a manner that places an unreasonable burden on our infrastructure.
  • Circumvent or attempt to circumvent any rate limiting, file size restrictions, or other technical measures we have implemented.
  • Upload files that infringe on the intellectual property rights of any third party without proper authorization.
  • Use the service to process classified, top-secret, or similarly restricted government documents, unless you have verified that online processing is permitted under the applicable classification guidelines.

File Upload Restrictions

The following restrictions apply to file uploads on PDFem:

  • Maximum file size: Each uploaded file may not exceed 50 megabytes (MB) in size.
  • Accepted file types: Only file types that are explicitly accepted by each tool may be uploaded. Attempting to upload unsupported file types will result in an error.
  • Maximum number of files: The number of files that can be uploaded at once varies by tool, with a general maximum of 20 files per conversion.
  • Rate limiting: To ensure fair use and service availability, we limit the number of conversions that can be performed per IP address within a given time period.

Intellectual Property

Your Content

You retain all ownership rights to the files you upload to PDFem. We do not claim any ownership or intellectual property rights over your content. We do not access, review, or use the content of your files for any purpose other than performing the requested conversion.

Our Service

The PDFem website, its design, code, features and functionality are owned by PDFem and are protected by applicable intellectual property laws. The "PDFem" name and logo are our trademarks. You may not reproduce, modify, distribute, or create derivative works of any part of our service without our prior written consent.

Disclaimer of Warranties

PDFem is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose.
  • Warranties that the service will be uninterrupted, secure, or error-free.
  • Warranties regarding the accuracy, reliability, or completeness of any conversion output.
  • Warranties that the service will meet your specific requirements.

While we strive to provide high-quality conversions, the output quality depends on various factors including the quality of the input file, the complexity of the content and the limitations of the conversion engines we use. We recommend that you review converted files before relying on them for important purposes.

Limitation of Liability

To the maximum extent permitted by applicable law, PDFem and its operators, employees and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, profits, or business opportunities.
  • Damages arising from the use or inability to use the service.
  • Damages arising from errors, omissions, or inaccuracies in conversion output.
  • Damages arising from unauthorized access to or alteration of your files.

Our total liability for any claim arising from or related to the use of PDFem shall not exceed the amount you paid for the service. Since PDFem is a free service, this means our maximum liability is zero.

Indemnification

You agree to indemnify, defend and hold harmless PDFem and its operators from and against any and all claims, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to your use of the service, your violation of these Terms, or your violation of any rights of any third party.

Service Availability

We make reasonable efforts to keep PDFem available and operational at all times, but we do not guarantee uninterrupted access to the service. The service may be temporarily unavailable due to:

  • Scheduled maintenance and updates.
  • Unplanned technical issues or server failures.
  • Factors beyond our reasonable control, such as natural disasters or internet outages.

We reserve the right to modify, suspend, or discontinue the service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

Termination

We reserve the right to block or restrict access to the service for any user who violates these Terms or who we reasonably believe is using the service in a manner that could harm the service, other users, or third parties. Since PDFem does not require user accounts, termination is typically implemented through IP-based restrictions.

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of PDFem after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PDFem operates, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the use of the service shall be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the competent courts of the applicable jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PDFem regarding the use of our service and supersede any prior agreements or understandings.
